Clients having web site work done will be asked to sign a simple agreement to go along with their work deposit. This agreement simply states they understand the following:
Web site development starts with a non-refundable deposit of $50.00. This is the minimum cost, for the simplest site provided by the developer. Developer will set up a minimum of one demonstration for the client. Client understands that depending on the complexity of their web site, the demo may or may not be in the form of one or more branded screen captures. In the event the Client's web site is going to be larger, a larger deposit may be required.
Client understands, all charges related to domains and hosting are sperate from the design and setup fees. These are server fees. Client also understands, in the event these services are not paid for, and are shut off, the developer may need to reinstall the clients web site upon reactivation. In the event this happens, reinstallation fees will apply.
Some Clients will desire to independently edit or update their web pages after completion of the site as a way to control costs and avoid the expense of a Maintenance Agreement. Note, however, that if this option is selected and the Client or an agent of the Client other than the Developer attempts to update the web site and damages the design or impairs the ability for the web pages to display or function properly, time to repair the web pages will be assessed at an hourly rate of $75. There is a one-hour minimum. In this regard, Clients are encouraged to obtain a Maintenance Agreement.
In the event the Client chooses to have someone other than the developer work on their web site once it is complete: the Client is asked to notify the developer so the work may be reviewed. This is not a control issue, it is a quality issue. In the event the new designer's work undoes an excessive amount of Abstractionz's work, (or adds graphics that devalues the original work) all branding to Abstractions will need to be removed.
On the issue of ownership. The Client owns the graphics and html documents that are made for them. These files include documents ending with the file extensions of .jpeg, .gif, .png, .html and .php. The Client does not own or have the right to programs used by the Developer, or the right to source files that were used to make the files listed above. Source files include PSD files, brushes, line art and patterns.
Client understands Abstractionz and the Developer prides itself in providing quality and timely service. As such, it is kindly asked that the Client remember, your web site can not be updated if you do not provide updates.
Once work is complete the Developer will issue a bill. The Client has 30 days to submit payment in full. In the event the Client is unable to do so, it is asked they work with the Developer to work out some form of payment plan. In the event the Client fails to arrange such within 90 days of the project being finished; the Developer will take the Client's web site offline. At this point, fees will apply for re-installation.
